1. Introduction

This Privacy Policy sets out how Kayon Capital (“Kayon Capital”, “we”, “us” or “our”) collects, uses, discloses and protects personal information obtained through this website (the “Site”) and in the course of its professional engagements. By using the Site or engaging our services, you acknowledge that your personal information will be handled in accordance with this Policy.

2. Data controller

Kayon Capital is a development feasibility and investment analysis practice located in Denpasar, Bali, Indonesia. Kayon Capital is the controller of the personal information described in this Policy. Enquiries concerning this Policy may be directed to kayoncapital@gmail.com or to +65 8406 8607.

3. Information we collect

3.1 Visits to the Site

The Site is hosted by Cloudflare. In order to deliver the Site and to protect it against misuse, Cloudflare processes technical information relating to each request, including the visitor’s IP address, browser type and the pages requested. Kayon Capital does not operate analytics or tracking services on the Site and does not set cookies of its own.

3.2 Bookings

Introductory consultations are scheduled through Cal.com. When you select a time, Cal.com collects your name, email address, the time selected and any responses you provide to its booking questions, and makes that information available to us for the purpose of holding the meeting. Cal.com’s handling of that information is governed by its own privacy policy.

3.3 Direct correspondence

When you contact us by email or by WhatsApp, we receive the information you choose to provide, which will ordinarily include your name, your contact details and a description of the site and proposal concerned. WhatsApp is operated by Meta Platforms, whose privacy policy applies to messages in transit.

3.4 Launch notification list

Prior to the launch of the Site, a preliminary page invited visitors to register an email address in order to be notified when the Site went live. Where an address was registered, we hold that address together with the date of registration, the country from which the request originated and the browser identification string transmitted with it. No other information was collected through that page.

3.5 Engagements

The preparation of a feasibility study requires information concerning the site and the proposal under review. This may include land certificates, permits, plans, financial assumptions and, where the agreed scope includes primary research, responses obtained from survey participants in the surrounding area. The handling of such material is governed by the written terms of the relevant engagement in addition to this Policy.

4. Purposes of processing

We use personal information for the following purposes only:

  • to respond to enquiries;
  • to schedule and conduct introductory consultations;
  • to perform and deliver engagements that have been instructed;
  • to notify persons who requested it that the Site had launched; and
  • to comply with legal and professional obligations.

We do not sell personal information and we do not use it for advertising.

5. Disclosure to third parties

Personal information is processed by the service providers that operate the Site and support our work, namely Cloudflare (hosting and storage of the launch notification list), Cal.com (scheduling), Google (email) and Meta Platforms (WhatsApp). Each provider processes information on our instructions or under its own published terms. We do not disclose personal information to any other party except where required by law or where you have requested it, for example where a study is provided to a financier or a prospective partner at your direction.

6. Cookies

The Site does not set cookies and does not employ tracking technologies. Third-party services linked from the Site, including Cal.com and WhatsApp, may set cookies on their own domains in accordance with their own policies.

7. Retention

Enquiries that do not result in an engagement are retained for twelve months from the date of the last correspondence and are then deleted. Records of engagements, including the study, the financial model and the material from which they were prepared, are retained for the period required by our professional and legal obligations. Addresses on the launch notification list are retained until the individual concerned requests removal.

8. Your rights

You may at any time request confirmation of the personal information we hold concerning you, request that it be corrected or deleted, or object to its use for a particular purpose. Under the Personal Data Protection Law of the Republic of Indonesia (Law No. 27 of 2022) and, where applicable, the law of your own jurisdiction, you may have additional rights, including the right to lodge a complaint with a supervisory authority. Requests should be sent to kayoncapital@gmail.com. We will respond within thirty days of receipt.

9. Security

Personal information is held on services that apply encryption in transit and at rest. Access is restricted to persons engaged in the enquiry or engagement concerned. No system can be guaranteed to be secure. In the event that we become aware of a breach affecting your personal information, we will notify you without undue delay.

10. Amendments

This Policy may be amended from time to time. The current version will be published on this page together with the date on which it took effect. Continued use of the Site after that date constitutes acceptance of the amended Policy.
