1. Acceptance of these terms

These Terms and Conditions (the “Terms”) govern your use of the website operated by Kayon Capital (“Kayon Capital”, “we”, “us” or “our”) (the “Site”). By accessing or using the Site you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Site.

These Terms govern the Site only. The provision of professional services is governed by the written terms of each engagement, as described in section 4.

2. Nature of the content

The Site describes the services offered by Kayon Capital and the manner in which an engagement is conducted. Its content is provided for general information about the practice. It does not constitute a feasibility study, a valuation, an investment recommendation or advice of any kind in respect of any particular site, project or decision.

3. No reliance

A feasibility study is prepared for an identified client in respect of an identified site, on the basis of the information available at the time of preparation, and is delivered under written terms. The summaries of past work published on the Site illustrate the nature of the questions such studies address. They are not offered as guidance in respect of any other site, and the figures contained in them are specific to the circumstances in which they were produced.

Any decision to acquire, hold, develop or finance property is yours alone. Kayon Capital does not guarantee any outcome. The purpose of a study is to determine whether a proposal is viable, and a finding that it is not viable is a legitimate result of that process.

4. Engagements

Every engagement is agreed in writing before work commences. The written terms of an engagement set out its scope, the fee, the delivery timetable and the obligations of each party. Fees are determined individually for each study. Work commences upon receipt of the agreed deposit. In the event of any inconsistency between the written terms of an engagement and the content of the Site, the written terms of the engagement prevail.

5. Intellectual property

The text, photographs, design and other content of the Site are the property of Kayon Capital or are used under licence. You may view the Site and share links to it. You may not reproduce, distribute or otherwise exploit the content of the Site for commercial purposes without our prior written consent. Ownership of the financial model delivered with a study is determined by the written terms of the relevant engagement.

6. Third-party services

Scheduling is provided through Cal.com and messaging through WhatsApp, and the Site may link to other services operated by third parties. Such services are subject to their own terms and privacy policies. Kayon Capital is not responsible for the content, availability or conduct of any third-party service.

7. Limitation of liability

Kayon Capital takes reasonable care in the preparation of the content of the Site but does not warrant that the Site is complete, accurate, current or free from error, or that it will be available at any particular time. To the fullest extent permitted by law, Kayon Capital shall not be liable for any loss or damage arising from reliance on the content of the Site or from any inability to access it. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law.

8. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Denpasar, Bali.

9. Amendments

Kayon Capital may amend these Terms from time to time. The current version will be published on this page together with the date on which it took effect. Continued use of the Site after that date constitutes acceptance of the amended Terms.
